| ProfileMarcus Brown is an associate in Winstead's Labor, Employment & Immigration Practice Group. Marcus counsels and represents clients in all areas of labor and employment law in federal and state court, as well as before administrative agencies, including matters concerning Title VII of the Civil Rights Act of 1964, the Texas Commission on Human Rights Act, the Americans with Disabilities Act, the Family and Medical Leave Act, the Fair Labor Standards Act, the Age Discrimination in Employment Act, misappropriation of trade secrets, covenants not to compete, and breach of employment agreements. Marcus also provides case assessments and strategy decisions, as well as advice to clients in various states regarding policies, procedures and various day-to-day employment issues. Marcus is currently expanding his practice to include representation of employers in non-immigrant visa matters.
Marcus is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization. Representative Experience

- Counseling clients regarding termination decisions, employee leave issues, and other personal matters
- Drafting and reviewing employment agreements, severance agreements, and non-compete and non-solicitation agreements
- Advising clients on compliance with state and federal wage and hour laws
- Prosecuting and defending claims regarding the enforcement of non-competition, non-solicitation and non-disclosure agreements
- Prepare and review employment policies and handbooks
- Prosecuting and defending unfair labor practices, including seeking injunctive relief against unions
- Preparing non-immigrant visa petitions (H-1B, L1 and TN petitions)
