| ProfileTom Reddin is the Chairperson of Winstead's Labor, Employment & Immigration Practice Group. Tom has more than 27 years of experience in labor and employment litigation, counseling and representing corporate clients in a broad range of complex employment-related disputes, including discrimination, wrongful discharge and business tort claims. Tom regularly provides risk management counseling and training to employers in the areas of hiring, termination, sexual harassment and effective workforce investigations. He has substantial experience in negotiating and drafting executive employment contracts, as well as the defense and prosecution of non-compete agreements.
Tom is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization. Representative Experience
- Litigation and compliance in employment-related statutory and regulatory areas, including EEO (Title VII, ADEA, ADA, Equal Pay Act and Affirmative Action), Fair Labor Standards Act, OSHA, SOX, FMLA and the WARN Act
- Represents employers in the investigation of charges and in the litigation of claims involving alleged violations of state and federal laws which prohibit discrimination on the basis of age, race, sex, national origin, workers' compensation claims, religion, disability and veteran status
- Advises clients on Fair Labor Standards Act compliance and defends clients in litigation concerning such matters as minimum wage, overtime, tip pooling and the various exemptions from overtime requirements
- Represents employers in actions alleging wrongful discharge, breach of employment contracts, and employment torts such as claims of intentional infliction of emotional distress, negligent hiring, invasion of privacy, slander and other defamation claims
- Drafting and negotiating executive employment agreements and noncompetition agreements
- Lead counsel in class actions involving race and sex discrimination and collective actions under the FLSA
- Counsels employers regarding union-prevention programs, union organizational efforts, strike management, defense of representational petitions, unfair labor practice charges and complaints
- Assists unionized employers with collective bargaining negotiations, arbitrations and decertification strategies
