| ProfileJosh Lebar has represented institutional, commercial and developer clients in the acquisition, financing, development, leasing and disposition of various property types, including office, retail, multi-family housing, health care facilities, and industrial as well as vacant land. His practice also includes representing a wide variety of borrowers in commercial and personal finance transactions. He has experience in drafting and negotiating purchase and sale agreements, financing documents, reciprocal easement and operating agreements, and leases.
In addition, Josh counsels lenders, owners and tenants of sports, entertainment, and multi-use facilities in the negotiation and documentation of concessions, management, premium seating, retail merchandising, branding, pourage, service rights and exclusivity agreements involved in the financing, development and ongoing operations at such specialized facilities. Representative Experience
- Preparing and negotiating land purchase and development agreements as well as reciprocal easement and use agreements for ground-up development and construction of retail shopping center and multifamily development projects
- Counsel to various public REITs in the acquisition, financing and disposition of more than $500 million in real estate
- Representation of startup multi-family housing company in connection with the acquisition, financing, and ongoing operation of a statewide multi-family housing portfolio
- Representation of tenant in connection with negotiation and documentation of a 300,000 square foot corporate headquarters office lease (2010 Dallas Business Journal "Office Lease of the Year")
- Representation of professional sports franchise owner in the preparation and implementation of a Suite Agreement and Personal Seat License program
- Representation of Fortune 250 corporation in nationwide real estate activities, including office leasing, raw land acquisition and disposition, sale leaseback transactions, real estate secured financing
- Representation of developer in connection with the renegotiation and extension of a $300 million Master Credit Facility secured by developer's inventory of raw land, hotel and conference center, multiple golf courses and office buildings
- Representation of Landlord in connection with the negotiation and documentation of a 100,000 square foot build-to-suit office/industrial building
- Representation of multiple bond insurers in the review, analysis, and renegotiation of real estate and income-generating documents involved in the development, financing, and operation of a to-be-constructed NFL stadium
- Counsel to a regional health care provider in the development of a form leasing program for use by in-house staff and brokerage company
- Representation of internationally known, premiere horse racing facility in the renegotiation of an existing concessions agreement
- Representation of public multi-family REIT in their capacity as landlord in all retail and office leases nationwide located in the company's multi-use projects
- Representation of banks and non-bank lenders in restructuring loans and foreclosures
