Elisabeth Wilson is an associate in Winstead's Commercial Litigation Group. She represents plaintiffs and defendants in commercial and business disputes across a wide array of industries, including real estate litigation, business tort litigation, insurance litigation, and bankruptcy-related litigation. Elisabeth also represents national banks, lenders, investors, and judgment creditors in bankruptcy matters under Chapters 7 and 11, primarily involving commercial real estate and small businesses.

Prior to joining Winstead, Elisabeth served as a judicial clerk to the Honorable Jane J. Boyle, U.S. District Court for the Northern District of Texas. Prior to her federal clerkship, Elisabeth served a one-year term as the briefing attorney for the Honorable Justice Douglas S. Lang, Texas Fifth District Court of Appeals.

Representative Experience

Litigation: Representation of plaintiffs and defendants in commercial litigation involving issues such as breach of contract, breach of fiduciary duty, wrongful foreclosure, lien priority, insurance disputes, suit to quiet title, and defense of consumer litigation.

Bankruptcy: Representation of secured creditors in Chapter 7 and Chapter 11 cases involving such issues as cash collateral, section 363 sales, relief from automatic stay, and plan confirmation; pursuit of dismissal of the bankruptcy case or appointment of a Chapter 11 Trustee; defense of violation of automatic stay litigation; defense of bankruptcy preference litigation; successful pursuit of contempt, sanctions, and criminal referral for bankruptcy crimes against the principal of a Debtor; and obtained a non-dischargeability judgment for an individual judgment creditor.
