David Odom is a registered patent attorney and member of Winstead's Intellectual Property Practice Group. David advises regional, national and international businesses in all facets of intellectual property and technology transactional matters. He works closely with clients to create tailored strategies that help protect and preserve development of intellectual property. His clients work in industries covering information technology, electronic, electrical, mechanical, computer hardware and software, telecommunications, energy, medical devices, and oil and gas, among others.
David counsels clients in patent, trademark, copyright and trade secret rights, and other related intellectual property rights and transactions, including the preparation and prosecution of patent and trademarks, and the management of full intellectual property portfolios and related dockets.
In the corporate area involving intellectual property, David assists deal teams and clients in identifying potential intellectual property or technology related issues that could significantly impact a client’s ability to acquire proper and sufficient rights to use or market intellectual property, technology, products, or services as a result of major transactions, such as mergers, acquisitions, divestitures, joint ventures or licensing situations, problematic employee and independent contractor agreements, unfavorable intellectual property or technology-related provisions in agreements, nondisclosure agreements, exclusivity arrangements, license restrictions, intellectual property restrictions, and distribution agreements.
David also provides intellectual property diligence actions, counseling services, and negotiation of intellectual property and technology representations and warranties to clients involved in merger and acquisition transactions and the licensing and exploitation of technology assets or intellectual property rights. He leads and manages technology and intellectual property due diligence teams in commercial deal transactions.
David is a former electronics engineering liaison in the aviation defense flight simulation industry and former U.S. Air Force officer and aviator with over 2000 combined flying hours in the KC-135A and B-1B bomber aircraft. He is also a Desert Shield and Desert Storm veteran.
