Wahlberg is a member of Winstead’s Real Estate Development & Investments Practice Group and Zoning & Land Use Practice Group. Jaclyn’s practice is focused on real estate acquisition and development, in addition to representing developers and land owners in zoning and land use matters before municipalities and other governmental entities. Jaclyn has experience in a wide variety of real estate transactions including drafting acquisition and disposition contracts; drafting easement, license and other similar agreements; structuring and administering residential and mixed-use communities; structuring and administering residential and mixed-use condominium regimes; representing developers and rental owners and operators on a variety of matters related to build-for-rent and single-family rental projects as standalone communities and within or adjacent to new and mature master planned communities; reviewing municipal and county code regarding land use and entitlements issues and drafting memoranda detailing findings; and drafting development agreements. Jaclyn also advises equity investors and lenders on entitlements. Jaclyn has experience with a wide range of development types in both urban infill locations and central Texas’ quickly growing suburban cities and counties.
Representative Experience
- Real Estate Development: Representation of developers and builders in the creation, development, governance, management and administration of master planned communities, mixed-use, residential, condominium and other covenant-controlled projects. Representation of developers and builders in the formation and operation of property owners associations.
- Acquisitions and Dispositions: Representation of both purchasers and sellers of real estate in the acquisition, disposition and development of improved and unimproved property.
- Land Use and Entitlements: Representation of developers and landowners in zoning, platting and subdivision, sign regulations, building permits, and easements and rights-of-way. Representation of developers and landowners in the documentation and negotiation of easements, development agreements and related agreements with municipalities and governmental entities.
