Mark Grobmyer is a member of Winstead’s Real Estate Development & Investments Practice Group, with a practice focused on condominium and HOA/POA governance and the legal infrastructure that supports residential, mixed-use, and office developments. He regularly advises clients on the creation, development, governance, management, and administration of condominiums and other covenant-controlled communities, including master-planned and mixed-use projects.

Mark works with developers, homebuilders, and community stakeholders on the governance and operational issues that arise across the lifecycle of a project—from initial structuring through implementation and long-term administration. His work includes advising on community governance frameworks for property owners associations (HOAs/POAs) and owners associations serving condominium, residential, and mixed-use communities.

He also represents build-for-rent (BFR) and single-family rental (SFR) owners and operators in transaction and governance-related matters, including acquisitions, dispositions, land-banking strategies, governance and control issues, exit-strategy planning, and regulatory compliance. Mark further advises master-planned community developers on planning and integration challenges associated with BFR and SFR projects within and adjacent to new and established communities.

In addition, Mark handles a broad range of commercial real estate transactions, including drafting and negotiating acquisition and disposition agreements, easements, and license agreements.

Before joining Winstead, Mark worked in Washington, D.C. as a legislative aide for U.S. Senator Blanche L. Lincoln of Arkansas. While in law school at the University of Arkansas, he served as a summer clerk in the Office of the Attorney General for the Republic of Palau.

Representative Experience

Condominium & HOA/POA Governance 

  • Counsel developers and builders in the formation, development, governance, management, and administration of condominiums, mixed-use communities, and other covenant-controlled developments.
  • Form and advise HOAs/POAs, including governance documentation and operational matters for residential and mixed-use communities.
  • Represent condominium, residential, and mixed-use owners associations on governance and administration.

Master-Planned & Mixed-Use Communities

  • Advise master-planned community developers on governance and implementation issues affecting residential and mixed-use projects.

BFR / SFR Governance & Transactions

  • Represent BFR and SFR owners/operators in acquisitions, dispositions, land-banking, governance structuring and control issues, exit planning, and regulatory compliance.
  • Advise master-planned community developers on integrating BFR/SFR projects within and near established communities.

Commercial Real Estate Transactions

  • Represent buyers and sellers in acquisitions, dispositions, and development of improved and unimproved real property.
  • Represent lenders and borrowers in permanent financing transactions involving hotels, multifamily, office and medical office, senior living, and industrial properties.
  • Represent landlords and tenants in negotiating lease agreements.

Entering two terms together in a search field will behave as though an "OR" is being used.  For example, entering "Antique Motorcars" as a Client Name search will find results with either word in the Client Name.

Operators

AND and OR may be used in a search.  Note: they must be capitalized, e.g., "Project AND Finance." 

The + and - sign operators may be used.  The + sign indicates that the term immediately following is required, while the - sign indicates to omit results that contain that term. E.g., "+real -estate" says results must have "real" but not "estate".

To perform an exact phrase search, surround your search phrase with quotation marks.  For example, "Project Finance".

Searches are not case sensitive.
